Understanding Chapter 13

Who should file Chapter 13?

Bankruptcy is not the right solution for everyone, and each type of bankruptcy is different.  Some reasons for filing Chapter 13 rather than Chapter 7 include the following:

  • You have an income that exceeds the median income for your household size in your applicable state and you do not qualify for Chapter 7
  • You have the ability to repay your debts
  • You have debt that cannot be discharged in a Chapter 7 filing but is eligible for discharge in a Chapter 13 filing
  • You have property you wish to keep that would not be exempt from liquidation in a Chapter 7 filing
  • You plan to cure arrearages on a mortgage to avoid foreclosure
  • You plan to cure arrearages on a vehicle loan to avoid repossession
  • You have certain tax obligations and would benefit from a structured repayment plan

To file for Chapter 13, you must have a regular income that will allow you to feasibly pay your debts in accordance with an established repayment plan.  While Chapter 7 bankruptcy is available to corporations and partnerships, Chapter 13 is restricted to individuals or sole proprietors.  Bankruptcy law and procedures are complicated, but qualified bankruptcy attorneys can help people choose the best means of getting through a financial crisis.
